    For the purposes of these general conditions of sale from here onwards the customer will be referred to indifferently as customer, consumer or user.


    Premise

    Scracchio offers its products on the website www.scracchio.com through its electronic commerce platform exclusively to its customers/consumers, as defined by the consumer code art. 3 paragraph 1, letter a), aged 18 (eighteen) and also in compliance with the legislation on electronic commerce. It is absolutely forbidden for people under the age of 18 (eighteen) to purchase and for this reason the order will not be processed if we encounter such a circumstance.


    By purchasing products on our site and confirming that they have read these General Conditions of Sale, the customer expressly declares that they are at least 18 (eighteen) years of age and that they understand these General Conditions of Sale which constitute a binding agreement. These General Conditions of Sale and all the contents of the website www.scracchio.com are written in Italian and refer mainly to the legislative decree of 6 September 2005 n. 206 and the legislation on distance contracts and the legislative decree of 9 April 2003 n. 70 regarding everything relating to electronic commerce.

    1. Contract

      These General Conditions of Sale have the task of regulating the offer of products, the purchase by the customer, the right of withdrawal and any other activity that takes place on the www.scracchio.com platform. The conclusion of the purchase contract for the products offered on the website www.scracchio.com will be obtained when the customer has filled in the purchase forms, accepted the General Conditions of Sale and sent the form itself by pressing the send button. The customer will receive a summary of the order as well as an order confirmation and acceptance email; in this way the order will be considered accepted and will be taken care of.


      Scracchio will have the right to collect orders also through alternative means such as: telephone, chat, email, Facebook, Instagram etc. and confirmation of having read these General Conditions of Sale will be given verbally and/or by alternative means. The confirmation email with the order summary will however provide evidence that you have read it. Scracchio reserves the exclusive right to refuse the order and not process it, without giving any justification to the customer but by sending a written communication to the customer.


      In the event of unavailability of the goods ordered by the customer, even if the order has been accepted, Scracchio will have the right, upon communication, not to process the order. In the event that the customer has already paid in advance, Scracchio will refund the sums paid no later than 5 working days.

    2. License:


      Unless otherwise indicated, Unibrands Retail Italia srl ​​and/or its licensed affiliates own the intellectual property rights for all material on Scracchio. All intellectual property rights are reserved. You may access it through Scracchio for your own personal use subject to restrictions set in the following terms and conditions.


      It is not allowed:

      • Copy or republish Scracchio's material
      • Sell, rent or sub-license Scracchio's material
      • Reproduce, duplicate or copy Scracchio's material
      • Redistribute Scracchio content
      • This agreement begins on the date indicated herein.

      Parts of this site offer you the opportunity to post and exchange opinions and information in certain areas of the site. Unibrands Retail Italia srl ​​does not filter, edit, publish or review comments before adding them to the site. The comments do not reflect the view and opinion of Unibrands Retail Italia srl, its agents and/or its affiliates.       The products offered on the website www.scracchio.com are all of high quality, the result of careful research and selection of suppliers who operate in compliance with national and European standards. The information contained in the product labels is prepared in accordance with the law and the truthfulness of the information is in any case guaranteed by the manufacturer even if the labels themselves are prepared by Scracchio. The information shown on the labels of the products on sale on the aforementioned platform may vary for reasons beyond our control and therefore there may be discrepancies between the information on the site and that indicated on the products delivered. The customer is required to always check the information on the purchased product before using it. Scracchio assumes no responsibility for the information reported on the products as this information is provided by the individual manufacturers. In case of doubts about the information on the labels, the Scracchio Quality department is available for any need, simply write to info@scracchio.com to obtain a quick response. The price, features and availability of products may change without notice.

    5. Prices

      All prices of products on the website www.scracchio.com include VAT as per current legislation. The price of transport, entrusted to external couriers, is indicated separately and is visible in the closing phase of the order before payment. Prices are updated periodically without prior notice. The prices present at the time of the order are the updated ones.

    6. Purchase Procedure and Method

      To be able to purchase the products on the site www.scracchio.com the customer is required to accept the General Conditions of Sale in full and without reservation, which constitute an integral and substantial part of the purchase order. These conditions have the value of a contractual proposal and do not bind Scracchio to execution as each order is subject to acceptance.


      When sending the order, the customer will receive an email with all the order data and the main information regarding the delivery of the products. The same is required to print or store a copy of this communication, immediately informing Scracchio in case of any errors.


      The Customer has the possibility within a maximum of 10 hours to cancel, postpone or request a change of shipping address of the order. Once the 10 hour period has passed, the order will be ready to be processed and it will no longer be possible to request cancellation or any changes.

      The Customer has the possibility to request the issuance of the invoice by selecting the appropriate box during the purchase procedure and must enter the billing data including: company name, complete address, tax code and/or VAT number, and SDI Recipient Code. The invoice will be automatically sent to the customer's tax drawer, as established by the relevant regulations. The customer is totally responsible for the correctness of the data entered and is aware that, in case of failure to request the invoice during the purchase phase, it will not be possible to request it from Scracchio subsequently.

    7. Payments

      For all purchases made on our platform we accept the following types of payment:

      • MASTERCARD
      • MAESTRO
      • AMERICAN EXPRESS
      • PAYPAL
      • CASH ON DELIVERY

      The circuits we use adopt high security protocols; credit and prepaid card data, managed by partner companies, are protected through SSL ('Secure Socket Layer') encrypted data transfer. With payment by cash on delivery, the order will be processed with cash payment to the courier.

    8. Shipping, delivery and acceptance of goods

      Deliveries made only in Italy are directed exclusively to customers who are at least 18 years of age and sent to the place indicated in the order. These are carried out with primary national express couriers who are totally responsible for delivery. Scracchio is not to be held responsible for bad behavior and/or any damage that the couriers may cause to the customer, of which we ask the customer to report to us.


      If parcels with obvious damage, breakages or other non-conformities are delivered to the customer, they must return the parcel to the sender and promptly notify Scracchio of this situation. In the event of collection of a damaged package, the customer undertakes to write on the courier's document the words "the package will be collected with reserve as it is damaged". Scracchio undertakes to replace the individual product if the customer documents damage to the product itself, all this without any charges to the customer.


      Delivery normally takes place on weekdays, in a period of time ranging from two to seven working days from the date of placing the order on our website www.scracchio.com.

    9. Right of withdrawal

      Pursuant to Legislative Decree 21 February 2014, n.21, the right of withdrawal is applicable to all purchases made on the website www.scracchio.com and the subjects who can benefit from it are those who, based on the Consumer Code art. 3 paragraph 1, letter a), are defined as consumers.


      The customer/consumer can withdraw within 14 days of receiving the goods without giving justification and in derogation of what is established by current regulations regarding the sending of a registered letter with return receipt for notification of the return, it is sufficient to complete the appropriate Return Form and send it following the methods indicated.


      Once the form has been received, the customer will receive an email authorizing the return of the goods which he can entrust to his trusted courier for their return to the Scracchio warehouses.


      In order to correctly comply with the return of goods, it is essential to keep the following in mind under penalty of forfeiture of the right to return:

      • Returned products must be intact and contained in the original packaging;
      • Partial returns are not permitted and for this reason all products ordered and received with a single order must be returned;
      • The return of products whose packaging has been opened or tampered with is not permitted and if only one of the products is opened or tampered with, the right of withdrawal will cease for the entire order;
      • Returned products, which are part of a single order, must be returned in a single shipment and no other forms are permitted;
      • The cost of returning the goods will be borne entirely by the customer, as will the responsibility for the goods in the event of loss or damage to the products;
      • The right of withdrawal is reserved exclusively for natural persons defined as "consumers" and purchases made by resellers or by people purchasing for resale purposes are excluded;
      • We will not accept used or damaged products which, if they reach us in this state, will be made available to the customer who can arrange for collection by courier within 15 days; after this date the products will be retained by the company and subject to destruction;
      The return of the goods purchased by the customer must take place at the following address and no addresses other than: Unbrands Retail Italia srl ​​- Returns and Refunds Office - Via del Melograno, 24 – 70022 Altamura BA are permitted.


      As soon as we receive the goods, we will promptly take charge of managing the refund request which, once compliance with the above conditions has been verified, will take place no later than 5 days from receipt of the goods. If the terms and conditions of return have not been respected, the Customer will not be entitled to a refund and the goods will be made available to him in the same state in which they arrived. The Customer can arrange for the collection of the goods within 15 days from the date of notification of receipt of damaged, opened or tampered products. After this period the goods will be retained for destruction by the company.


      The customer will be entitled to a refund not only of the sums paid for the purchase of the products but also of the shipping costs incurred at the time of purchase. The only costs that he will have to bear are those of returning the products purchased as required by art.67, paragraph 3 of the Consumer Code.


      The refund will be made exclusively to the name of the person who made the purchase using the same means (credit card/bank transfer) used to pay for the order.     10. Major force

      It is Scracchio's right not to process the order and for this reason it will not be responsible in the event of non-performance if this is caused by unforeseeable events or events that cannot be reasonably controlled. These include catastrophic natural events, popular uprisings, wars, lack of electricity, acts of terrorism, general strike of public and/or private workers, strike and/or restrictions relating to the viability of couriers and air connections.

    11. Warranty and Liability for defective products

      The guarantee on the conformity of the products to which the consumer is entitled is 24 months from delivery of the goods and in the event of a defect it must be communicated to Scracchio promptly. To exercise this right, the Customer must send an immediate communication to Scracchio by e-mail indicating the order number and the detailed description of the defect found in the product, it is also necessary to send clear and complete photographic material showing the problem.


      If Scracchio actually ascertains the lack of conformity of the product, the customer has the right to obtain its replacement, upon return of the defective product.


      As regards any damage caused by product defects, the provisions of Italian Legislative Decree no. apply. 206/2005 (Consumer Code) and the European Directive 85/374/EEC. Scracchio, as an online distributor, with the indication of the production plant on the label, is relieved of any responsibility.

    12. Data security

      The security of customer data is a fundamental factor and for this reason Scracchio adopts protection measures that safeguard data from theft, loss, manipulation and falsification by third parties. Nonetheless, Scracchio cannot guarantee the customer that the data can be viewed or intercepted by unauthorized third parties.

    13. Cookies

      The site uses cookies to personalize the online experience. By accessing Scracchio.com, you accept the use of required cookies. A cookie is a text file that is placed on your hard disk by a web server. Cookies cannot be used to run programs or send viruses to your computer. Cookies are uniquely assigned to you and can only be read by the web server in the domain that issued the cookie.
